Seems incredibly irresponsible they're not contained in sea pens, to be frank.

I think sea pens were proposed but experts were worried the stress of being rounded up and confined would kill the remaining vaquitas. I know narwhals aren't kept in captivity for that very reason.

Narwhals aren't about to go extinct due to illegal poaching (where they get caught as bycatch). When there is a choice between a risk and a sure failure, take the risk.
